Welcome to Devil’s Luck Studio and Devil’s Luck Jewelry. These Terms and Conditions (“Terms”) govern your use of our website, services, and purchases of premade and custom artwork and jewelry. By accessing our site or placing an order, you agree to be bound by these Terms. Please read them carefully before using our services.

 

1. Overview

This website is operated by Devil’s Luck Studio. Throughout the site, “we,” “us,” and “our” refer to Devil’s Luck Studio and Devil’s Luck Jewelry. We provide this website, including all information, tools, and services available, conditioned upon your acceptance of these Terms, our Privacy Policy, and any additional policies referenced herein.

 

2. Eligibility

  • You must be at least the age of majority in your jurisdiction to purchase from our store.
  • If you are under the age of majority, you may only use our services with the involvement and consent of a parent or guardian.

 

3. Site Access & Changes

  • Access to our website is permitted on a temporary basis. We may suspend, withdraw, or restrict access without notice.
  • Content, product details, and pricing may change at any time. We are under no obligation to update material that may be out of date.
  • You are responsible for ensuring that anyone accessing our site through your internet connection complies with these Terms.

 

4. Privacy

Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By agreeing to these Terms, you also acknowledge and consent to the practices described in our Privacy Policy.

 

5. Contract Formation

  • No contract exists until we accept your order with a confirmation email and full or deposit payment is received.
  • We reserve the right to refuse orders due to payment authorization failure, shipping restrictions, quality control issues, out-of-stock items, or errors in pricing/content.
  • Only adults (18+) may enter into legally binding contracts.

 

6. Products and Services

  • Premade Artwork & Jewelry: Items are sold as-is and may have limited quantities.
  • Custom Orders: Custom artwork (via Devil’s Luck Studio) and custom jewelry (via Devil’s Luck Jewelry) are made to your specifications. Once production begins, custom orders are non-refundable except in cases of defect or error on our part.
  • Variations may occur due to screen settings, natural materials, or handmade processes.

 

7. Pricing and Payment

  • Prices are listed in Canadian currency (CAD) and may change without notice.
  • Payment must be made in full at the time of order unless otherwise specified for custom work.
  • Orders will not ship until the final payment has cleared into the Devil’s Luck Studio account.
  • We accept major credit cards and secure online payment methods.
  • All cardholders are subject to validation checks and authorization by the issuer.
  • You are responsible for applicable taxes, duties, or customs fees.

 

8. Shipping and Delivery

  • Shipping costs are calculated at checkout.
  • Delivery times are estimates and may vary.
  • All parcels should be opened in the presence of the courier to confirm contents and condition. Failure to do so may limit our ability to assist with claims for loss or damage.
  • International customers are responsible for customs duties and taxes.

9. Returns, Exchanges, and Refunds

  • Premade Items: Eligible for return/exchange within 14 days if unused, in original condition, and packaging.
  • Custom Orders: Final sale once production begins.
  • Defective/Damaged Items: Contact us within 5–7 days of delivery. We may require the item returned before replacement or refund.
  • Refunds are processed to the original payment method; processing times may vary by bank.

10. Cancellation Policy

  • Premade Items: Orders may be cancelled within 24 hours of purchase for a full refund, provided the item has not yet shipped. After this period, cancellations are not guaranteed.
  • Custom Jewelry (Devil’s Luck Jewelry): Once a deposit is paid and production has begun, cancellations are not permitted. Deposits are non-refundable.
  • Custom Artwork (Devil’s Luck Studio): Design fees are non-refundable. If cancellation occurs before production begins, only the design fee is retained. Once production begins, no cancellations or refunds are possible.

11. Devil’s Luck Jewelry – Custom Jewelry Terms

  • Design Fees & Deposits: Non-refundable design fee required. 50% deposit (including design fee) due before production. Balance due upon completion.
  • Revisions:  Any additional client-requested changes after production has started may result in additional fees and extended timelines.
  • Artistic Discretion: Commissioning implies acceptance of the artist’s style.
  • Intellectual Property: Artwork remains property of Devil’s Luck Studio unless otherwise agreed. Clients receive a personal-use license only.
  • Upon completion, you will receive photos of your finished piece along with an invoice for the remaining balance.

 

12. Devil’s Luck Studio – Custom Artwork Terms

  • Design Fees & Deposits: Non-refundable design fee required. 60% deposit (including design fee) due before production. Balance due upon completion.
  • Revisions:  Any additional client-requested changes after production has started may result in additional fees and extended timelines.
  • Artistic Discretion: Commissioning implies acceptance of the artist’s style.
  • Intellectual Property: Artwork remains property of Devil’s Luck Studio unless otherwise agreed. Clients receive a personal-use license only.
  • Upon completion, you will receive photos of your finished piece along with an invoice for the remaining balance.

 

13. Disclaimer of Warranties

  • Products and services are provided “as is.”

Warranty of Title and Originality

  • The Artist warrants that they are the sole creator and owner of the custom artwork / jewelry and have full authority to sell, license, or transfer it. 

Warranty of Materials and Workmanship

  • The Artist warrants that the custom artwork / jewelry has been created using materials appropriate for the piece, and that it is free from defects in materials and workmanship under normal use and display conditions.
  • This warranty is for a period of one (1) year from the date of delivery.

Exclusions and Limitations

  • This warranty does not cover damage resulting from:
    • Improper handling, storage, or installation by the Buyer.
    • Exposure to direct sunlight, moisture, smoke, or other environmental conditions beyond normal indoor display.
    • Accidents, neglect, or unauthorized conservation/restoration attempts.
    • Natural aging of materials (e.g., slight fading, cracking of paint, or patina development) is not considered a defect.

Remedies

  • If a defect covered by this warranty arises within the warranty period, the Artist will, at their discretion:
    • Repair the custom artwork / jewelry,
    • Replace the artwork / jewelry with a comparable piece, or
    • Refund the purchase price upon return of the artwork / jewelry.

Transferability

  • This warranty applies only to the original purchaser and is not transferable unless otherwise agreed in writing.

Governing Law

  • This warranty shall be governed by and construed in accordance with the laws of the jurisdiction where the custom artwork / jewelry was sold.

 

14. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages. Liability is limited to the purchase price of the item.

 

15. Intellectual Property

  • All content, designs, images, and branding are the intellectual property of Devil’s Luck Studio / Devil’s Luck Jewelry.
  • You may not reproduce, distribute, or use content without written permission.

 

16. User Conduct & Prohibited Uses

You agree not to use our site or services for unlawful purposes, infringement, harassment, uploading malicious code, or other prohibited uses.

 

17. Indemnification

You agree to indemnify Devil’s Luck Studio / Devil’s Luck Jewelry against claims arising from your breach of these Terms.

 

18. Severability

If any provision is found unenforceable, the remainder remains valid.

 

19. Termination

We may terminate access immediately for breach of Terms. You remain liable for amounts due up to termination.

 

20. Entire Agreement

These Terms, together with our Privacy Policy and referenced policies, constitute the entire agreement between you and Devil’s Luck Studio / Devil’s Luck Jewelry, superseding prior agreements.

 

21. Governing Law

These Terms are governed by the laws of Canada (Ontario jurisdiction).

 

22. Changes to Terms

We may update these Terms at any time. Continued use of our services constitutes acceptance of changes.
